Gun Control & Roe v. Wade – Supreme Court Rulings

This week, Liberals got a double-shot of bad news from opinions handed down from the United States Supreme Court.  Even as Congress passed a dubious gun control bill, signed by President Joe Biden, the USSC was overturning a decades-old New York State law that required citizens to show cause to be able to apply for a concealed carry handgun permit.  The streak of higher court rulings against any hurdles for law-abiding citizens to bear arms remains intact.  Such so, the legislation Biden signed will likely be struck down as well, especially the ‘red flag’ portion, which would allow citizens with legal ownership of firearms to have said firearms confiscated by authorities if the owner was deemed ‘at risk’ by…someone.  This deprivation of due process will evaporate as soon as a case is brought—it is blatantly unconstitutional. 

But the gun control failure was not enough to get Liberals protesting in the street.  That happened Friday, June 24, as USSC declared ‘Roe v Wade’ unconstitutional and voided that 49-year-old decision.  They determined that the ‘right to an abortion’ is NOT in the text of the Constitution, therefore, it should be up to each individual State to decide.  I checked the text of the Constitution—there is no ‘right to an abortion’ in there at all.  The 1973 ruling created a ‘right’ out of thin air, stretching the 4th and 14th Amendment meanings so far out of context, even the late Liberal icon Ruth Bader Ginsberg said it was a terrible ruling, sure to be overturned.  And so it was. 

This caused news media to explode over the news.  Protestors, prepared by an illegal leak of this opinion weeks ago, filled the streets and government areas. You would’ve sworn that the Court had made abortion a crime—it did no such thing. 

Not a single abortion case was reversed by this ruling.  Pushing such law to the States is actually a correct application of the Constitution (see 10th Amendment).  Letting the voters of States decide how or if abortion should be administered in their State is exactly how Democracy is SUPPOSED to work.  But now people are up in arms!  Why?

This is the bedrock issue for Liberals, and has been since 1973.  No other issue defines Modern Liberalism more than the right for an expectant mother to dispose of her unborn child.  The reasoning is the logical conclusion of the Women’s Liberation movement of the 1960s: women should be able to have sex, just like their male counterparts, with no consequences whatsoever.  The natural and predictable effect of sex on a fertile woman should be disposed of post haste, so that the woman in question can continue her lifestyle without worrying about offspring.  Men have been abdicating their responsibilities in this regard for decades, if not centuries, so it’s all fair, right?  If you think ‘two wrongs don’t make a right’, you’re thinking like me.  Not only should women control EVERY sexual situation (note that rape and incest are ALREADY felonies), the men should be forced to step up and take financial and emotional responsibility for their actions—remember, the child in question didn’t get a vote here.  This is the only place where Liberals condone prematurely ending a life—they give more rights to a criminal convicted of a heinous crime than an innocent unborn child.  Yet only the criminal somehow deserves a shot at rehabilitation—the innocent child, not even a shot at life.  And note that they don’t just end the child, but all future generations that child may create, via marriage and THEIR children.

You may ask, “Why this issue?”  Or, “Why does this issue invoke such raw hatred?”  I have a theory, and it can only be a theory, as I am on the other side of this divide.  My theory goes like this:  for decades, Liberals have RELIED on the Supreme Court to implement their agenda items.  Liberals, even with overwhelming majorities in the US House and Senate, along with the President, have NEVER enjoyed the support of the majority of the US people, for their intended policies.  It is important to remember that Democrats have held control of the Legislative and Executive Branches far more than the GOP since 1960:  6 Presidents to 6, but from 1960 to 1981, and 1987 to 1995, and 2009 to 2013, Democrats controlled BOTH houses of Congress!  The GOP only had such control from 1995 to 2001, and 2015 to 2019.  During all of those periods of controlling all of government, they did not enact the sweeping changes Liberals wanted, with Medicare, Medicaid, and Obamacare as notable exceptions.  But Liberals figured out a way to get other policies enacted:  The Court.  They don’t even have to have a record of how they vote, or what they support—no Congressional vote is needed!  Just convince five Justices in robes that your idea has merit.  And please, do not push Civil Rights into this discussion:  the Civil Rights legislation of the mid-1960s was approved with a majority of GOP support—Democrats not only didn’t support it, they still have the record for the longest Senate filibuster in US history, fighting against the Civil Rights Act.  Up until now, if Liberals wanted an issue shoved into implementation, they could rely on Liberal, like-minded Justices to see things their way. 

Then a perfect storm hit from 2016 to 2020.  Not only did the Senate remove the practice of the filibuster over Judicial appointments (see:  Harry Reid), the GOP controlled a small majority in the Senate, and had an unknown quantity in GOP President Donald Trump.  Where the third element of this storm occurred:  THREE Supreme Court vacancies opened up during this time frame, including the passing of Liberal icon Ginsberg.  Trump did EXACTLY as his GOP faithful hoped for:  he appointed Justices Gorsuch, Kavanaugh, and Barret to the Court, changing the Court from a Liberal advantage to a supposed Conservative one.  And just as the Court finagled a case before it in 1973 to create ‘Roe v Wade’, this Court took on an ‘abortion rights’ case.  Anyone thinking those last two sentences reflect accidental happenings need to think again.  Of note are at least 13 States that have ‘trigger’ legislation that automatically went into effect with the ‘Roe v Wade’ overturn.  Hint:  NONE of those States made abortion easier to obtain.

So, the Court did what was hoped for by many who’s only support of Trump was his Judicial appointments.  Many folks begrudgingly supported Trump, while severely hating his personality and persona.  But Trump’s legacy isn’t only the 4 years he held office.  His judicial appointments are lifetime tenures.  And the lone branch of government that Liberals could be sure of is no longer within their control.  The Court is now issuing decisions based upon the actual wording of the US Constitution, not on some derived other method, such as the law of other countries, or what they WANT the Constitution to say.  This is the ‘originalist’ view, rather than the ‘living, breathing document’ view that says whatever the interpreter wishes.  And this is horrible news for Liberal folks.  And they know it.  The full impact of this version of the Court may not be known for decades.  Many of the Conservative side of the Court are not young (Clarence Thomas is 74, Samuel Alito is 72).  All of the others are in their 50s and 60s.  Barring retirements or health issues, this is the Court that will preside for many years.  The Liberal lurch of the policies of the US government since at least 1960 may have been halted, if not reversed.  And the performance of the current Democrat regime may result in a stronger GOP wave in the mid-terms in November.  Traditionally, the Party in power loses a few seats in the mid-terms, but these are not traditional times.  From foreign policy (Russia, China, Afghanistan, etc.) to domestic policy (inflation, energy policy, etc.), this admin is doing historically poorly, across all demographics.  If the GOP regains control of the Senate, the House, or both, we may see a pendulum swing of policy direction, with the Liberals’ only hope as President Joe Biden’s ability to veto bills.  If the mid-term swing is as large as some predictors say, the GOP may even gain enough leverage to override those vetoes.  And the Presidential election of 2024?  Anyone’s guess.  But the GOP also has a history of failure to lead, so there’s that.

  1. Lendell, your point about the Liberals relying on SCOTUS to enact their agenda was spot on. But I go a bit further and say the Classical Liberal did not, it was the LINOs (Liberal in Name Only). Merely the Commies looking to weaken then destroy the strongest bastion of freedom in the world.
